About LUBA

LUBA's mission is to provide a specialized appellate review body that will (1) provide an accessible forum for resolving land use disputes quickly and efficiently and (2) make its decisions available as a decision-making resource to state and local legislators, land use professionals, city and county land use decision makers, property owners, and residents of Oregon. Summary of Duties and Responsibilities


Board Members are co-equal and each Board Member serves in a dual capacity as agency administrator and adjudicator. The function of a Board Member is similar to that of an appellate court judge. Board Members resolve motions, read briefs, conduct oral arguments, and author and review opinions and orders in which they analyze and decide legal issues. Most LUBA orders and opinions are the product of collaboration and revision. Board Members are responsible for publishing LUBA opinions and orders, preparing, presenting, and managing the agency’s budget, and attending meetings with the governor’s office, other agency heads, and legislative committees. LUBA has outside-agency support for Human Resources, Finance, and Information Technology. Board Members inform state agency and legislative authorities of land use issues, as requested. Board Members frequently speak publicly on developments and issues in land use law.

Each Board Member is expected to serve a term as the Board Chair. The Board Chair is chosen by the Board Members and is responsible for assigning cases and has primary responsibility for handling day-to-day administrative matters, in addition to the other duties required of a Board Member.

The incumbent is expected to perform position duties in a manner that promotes customer service and harmonious working relationships. This includes treating all persons respectfully, engaging in effective working relationships with all staff, demonstrating openness to constructive feedback, and contributing to a positive and productive work environment.

Minimum Qualifications

  • Active membership in good standing of the Oregon State Bar;
  • At least 8 to10 years of legal practice with demonstrated substantial experience in land use law, appellate law, or a closely related area of the law, including appellate clerkships; and
  • Proficiency in electronic word processing.

  • Interpersonal, teamwork, and collaboration skills;
  • Ability to analyze and apply LUBA rules and procedures, Oregon Revised Statutes, Oregon Administrative Rules, and case law;
  • Ability to prioritize and produce high-quality written legal work product under demanding deadlines;
  • Budget preparation and management experience; and
  • Ability to successfully work independently.

This also includes most major state agencies and departments headed by policy-making boards which are appointed by the Governor. Members of Oregon State Boards and Commissions are vital participants in statewide decision-making and dedicated individuals have the opportunity to participate in developing a wide variety of important governmental policies. Major issues range from consumer protection, economic development, education, conservation, and health care — all of which are critical to the ongoing success of the State of Oregon.
